Tooele Army Depot Stipulation and Consent Order
The Director of the Division of Solid and Hazardous Waste is proposing to enter into a Stipulation and Consent Order (No. 1303004) with Tooele Army Depot to resolve a Notice of Violation (No. 1301001) issued on February 6, 2013.
The public comment period to receive comments on the Tooele Army Depot Stipulation and Consent Order will commence on May 2, 2013, and end on June 3, 2013 A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Director in writing which meets the requirements of Utah Administrative Code R315-311-3.

Clean Harbors Grassy Mountain Treatment Variance
The Director of the Division of Solid and Hazardous Waste has receive a site-specific treatment variance request , submitted by Clean Harbors Grassy Mountain, LLC. Grassy Mountain is proposing to treat the waste directly with a stabilization method rather than going through the initial retorting of the waste. This treatment variance is requested because Grassy Mountain is unable to locate a mercury recovery facility that is permitted to treat waste streams with the listed waste codes associated with the waste.
Public comment period begins May 7, 2013 and will end on June 6, 2013. A hearing will be held on June 4, 2013 at the Tooele County Courthouse at 6:00 p.m. Notice will be published in the Salt Lake Tribune, Deseret News and Tooele Transcript on May 7, 2013.
This site-specific treatment variance request will be presented at the June 13, 2013 meeting of the Utah Solid and Hazardous Waste Control Board.

Stakeholder Comments for Proposed Used Oil Rule Changes
The proposed used oil rule changes are presented for stakeholder review and comment. The proposed rules contain both substantive and non-substantive changes. This comment period is an opportunity for stakeholders to review and comment on the proposed changes prior to submission to the Solid and Hazardous Waste Control Board and public comment period. Stakeholder comments may be submitted between June 3 and July 5, 2013. Comments may be email to Deborah Ng, Used Oil Recycling Program Manager. Please place in the subject line "Proposed Used Oil Rules".
Energy Recycling Technologies LP
Energy Recycling Technologies LP has applied for a small incinerator permit for recycling waste tires on private land owned by Energy Recycling Technologies LP located at 740 North 400 East, Huntington, UT. This permit is for the incineration of waste tires which are defined as non-hazardous solid waste. The facility as described in this permit consists of two metal buildings, various storage silos, hopper bins, a truck scale, transfer lines, and a maintenance building on 2.27 acres. The facility proposed to thermally treat up to 10 tons of scrap tire shreds using pyrolysis technology. The system will produce tire derived oil which will be processed into alternative diesel, alternative gasoline, and a heavy residual oil. The only waste the facility can accept is waste tires. All operations, including storage and processing of waste tires and waste tire derived materials, will be conducted inside the buildings. The small incinerator application has been reviewed by the Division of Solid and Hazardous Waste and a draft permit has been prepared.
The public comment period to receive comments on the draft small incinerator permit will commence on June 7, 2013 and end on July 8, 2013. A public hearing may be held if a timely request is made to the Director of the Division of Solid and Hazardous Waste in writing.

Wasatch Regional Landfill Inc.
Wasatch Regional Landfill Inc and the State of Utah School and Institutional Trust Lands Administration have asked for a modification of their Class V landfill permit. The landfill is located on 2,000 acres on the west side of County road 128 approximately six miles north of Interstate 80 in Tooele County. Modification of the permit will allow the landfill to construct a second double lined pond for the storage and evaporation of liquid waste. The lined area of the pond will cover approximately 2.0 acres, and the total construction area is approximately 4.6 acres.
The proposed permit modification for the liquid waste pond has been reviewed and determined to be complete and in compliance with the Utah Solid Waste Permitting and Management Rules. The Director of the Division of Solid and Hazardous Waste is seeking public comment on the proposed permit modification.
The public comment period begins on June 7, 2013 and ends July 8, 2013. A public hearing may be held if, within 15 days of publication of the notice, a request is made to the Director in writing and meets the requirements of Utah Administrative Code R315-311-3.

Laundry Supply Site Management Plan
The Director of the Division of Solid and Hazardous Waste is soliciting public comment on a site management plan (SMP) for the Laundry Supply Company located at 3785 West 1987 South, Salt
Lake City, Utah. In response to contaminated soil and groundwater at the site, the company has
conducted corrective action and has been monitoring the groundwater for a number of years. An environmental risk assessment has been approved which shows levels of constituents in groundwater are protective for commercial and industrial use. The SMP outlines continued monitoring of groundwater for natural attention of the contaminants left in place.
The public comment period to receive comments on the Laundry Supply Company SMP will commence on June 10, 2013 and end on July 12, 2013. A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Director of the Division of Solid and Hazardous Waste in writing which meets the requirements of Utah Administrative Code R315- 311-3.

Proposed Rule Change
Milestones
An Emergency Permit (UT#-06-2013) was issued to the Tooele Army Depot (TEAD) to store 52 demolition charges, 2,575 anti-personnel mines, 12 warheads, and 630 cartridges in 11 pits, totaling 7,488.42 pounds of net explosive weight with donor material at TEAD's Open Burn/Open Detonation (OB/OD) facility. Permit necessary due to weather conditions not allowable within limits of the TEAD OB/OD permit. Permit was effective May 15, 2013 and expired on May 22, 2013. Notice was published in the Tooele Transcript, Deseret News and Salt Lake Tribune on June 4, 2013. For more information call David McCleary at 801-536-0237.
