EnergySolutions, LLC

5/19/09 – EnergySolutions, LLC will hold a public information meeting at 7:00 p.m. at the Tooele County Courthouse for a Class 2 modification (09.01357).  EnergySolutions proposes a change in sampling frequency from semi-annual to annual, the removal of monitoring well GW-55, various minor changes and clarifications for reporting requirements, and updates to form numbers.  Comment period: 4/23/09 – 6/22/09.  Contact: Otis Willoughby

6/24/09 – EnergySolutions, LLC will hold a public information meeting at 7:00 p.m. at the Tooele County Courthouse for a Class 3 modification (09.01370) to its State-issued Part B Permit.  EnergySolutions proposes to receive water reactive and air reactive wastes for management at the Clive facility.  The Permit language requires that, prior to receipt of this type of waste, a waste management plan detailing the receipt, management, and disposal of the waste shall be provided to the Executive Secretary of the Utah Solid and Hazardous Waste Control Board.  Comment period: 5/28/09 – 7/27/09.  Contact: Otis Willoughby


Tooele Army Depot

6/9/09 – Tooele Army Depot will hold a public information meeting at 6:30 p.m. at the Tooele County Building for a Class 2 modification (09.01338) to its Post Closure Permit.  The purpose of the modification is to update the status of corrective action being considered or implemented over the past year, document the results of groundwater modeling efforts, and update the inventory of monitoring wells included in the permit monitoring network.  Comment period: 4/28/09 – 6/29/09.  Contact: Helge Gabert


Tooele Chemical Agent Disposal Facility

7/8/09 - The Tooele Chemical Agent Disposal Facility (TOCDF) will hold a public information meeting at 6:00 p.m. at the Tooele Chemical Stockpile Outreach Office for a Class 2 permit modification request (09.01638).  TOCDF requests to revise the sampling frequency and the suite of analyses for waste streams associated with ash generated from the processing munitions, bulk containers, and secondary wastes in the Metal Parts Furnace( MPF), and the suite of analyses associated with the non-Agent Contaminated Hydraulic Fluid.  Comment period: 6/2/09 – 8/3/09.  Contact: Tina Mercer

7/15/09 - The Tooele Chemical Agent Disposal Facility (TOCDF) will hold a public information meeting at 6:00 p.m. at the Tooele Chemical Stockpile Outreach Office for a Class 3 permit modification request (09.01819).  The Chemical Agent Munitions Disposal System (CAMDS) has completed its operational mission and is currently in the process of attaining formal RCRA Closure, which includes decontamination, equipment removal, and building removal as specified in the CAMDS Closure Plan.  Until the CAMDS facility has been dismantled to the extent required for RCRA Closure status, the CAMDS RCRA Permit is required to remain effective.  On 9/24/09, the CAMDS Permit expires.  Rather than renewing the CAMDS Permit as a continuing separate entity in the RCRA Permit realm, it is proposed to incorporate into the TOCDF Permit those elements of the CAMDS Permit required to support continuing CAMDS work.  Comment period: 6/11/09 – 8/10/09.  Contact: Tina Mercer


Dugway Proving Ground

7/7/09 – Dugway Proving Ground will hold a public information meeting at 7:30 p.m. at the Tooele County Courthouse for a Class 2 modification (09.01707) to its RCRA Part B Permit.  Dugway proposes to revise Attachment 1-10 to implement laboratory method CL-071R, revise Module IV in accordance with a Stipulation Consent Order, and insert Post-Closure Plans for SWMUs and HWMUs as attachments into Module VII.  Comment period: 6/4/09 – 8/3/09.  Contact: Doug Taylor

Garfield County

Garfield County has submitted a permit renewal application to continue operation of the Dead Animal Class IVb landfill located near the town of Panguitch, Utah. The Class IVb landfill receives waste described in the permit application as dead animals that will be placed in a disposal trench area and covered each day.

The Division of Solid and Hazardous Waste has reviewed the permit renewal application and a draft permit has been prepared.  Before taking action on the request, the Division is providing a public comment period to receive input.  The public comment period on the draft permit begins May 28, 2009 and will end June 29, 2009.  A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Executive Secretary in writing and meets the requirements of Utah Administrative Code R315-311-3.

American Gilsonite Company (AGC)

American Gilsonite Company (AGC) has applied for a Solid Waste Closure/ Post-closure permit for the Class IIIb Landfill on private land owned by AGC located 2.5 miles northeast of Bonanza, Utah.  Class IIIb landfills are non-commercial landfills that may receive for disposal only industrial nonhazardous solid waste.  From 1982 to 2003 AGC disposed, in a trench resulting from mining operations, solid waste generated by mining operations.  AGC has ceased disposal operations and wishes to close the landfill.  The closure plan has been reviewed by the Division of Solid and Hazardous Waste and a draft permit has been prepared.  The public comment period on the draft permit begins June 3, 2009 and will end July 2, 2009. 

A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Executive Secretary in writing and meets the requirements of Utah Administrative Code R315-311-3.

West Desert Tire Recyclers (WDTR)

West Desert Tire Recyclers (WDTR) has applied for a Waste Tire Storage permit for waste tires stored prior to recycling on private land owned by CHB Windfalls LC at 239 North Old Highway 91, Hurricane, Utah. The public comment period on the draft permit begins June 2, 2009 and will end July 2, 2009. 

A public hearing may be held if, within 15 days of publication of this notice, a request is made to the Executive Secretary in writing and meets the requirements of Utah Administrative Code R315-311-3.

Brush Resources

Brush Resources has applied to renew their permit to operate a Class IIIb landfill located northwest of the cross roads of W. Brush Wellman Road and U.S. Highway 6, approximately 10 miles north of Delta, Millard County.  The landfill accepts obsolete equipment, pallets, and other debris from plant operations, empty drums, small amounts of asbestos and industrial debris.  The Permittee may accept asbestos, sludge for soil covering purposes, and PCB’s under conditions specified in the permit.  The permit application has been reviewed by the Utah Division of Solid and Hazardous Waste and a draft permit has been prepared.  The Utah Solid Waste Permitting and Management Rules provide for a 30-day public comment period to receive comments on the applications and the draft permit before final action by the Executive Secretary of the Utah Solid and Hazardous Waste Control Board.

The public comment period for the application and draft permit will commence on May 27, 2009 and end on June 25, 2009.  A public hearing may be held if the hearing is requested within 15 days of the publication of this notice and otherwise meets the requirements of Utah Administrative Code R315-311-3(2).

Ensign-Bickford Company

The Utah Division of Solid and Hazardous Waste is soliciting public comments for the revised Consolidation Corrective Action Management Unit (CAMU) Application and the draft Corrective Action Order (CAO)  No. 0906006 for consolidation of contaminated soil at an existing contaminated area at The Ensign-Bickford Company located near the mouth of Spanish Fork Canyon at the junction of Highways 6 and 89, Spanish Fork, Utah.  The CAMU Application includes details on the location of soils to be consolidated, construction, soil cover, groundwater monitoring, and inspections. The CAO designates a Consolidation CAMU, which provides EBCo with approval and conditions for construction and management of the CAMU. 

The public comment period for the revised CAMU Application and draft CAO will commence on Thursday, June 25, 2009, when the public notice shall be published in the Salt Lake Tribune, Deseret Morning News, the Daily Herald and the Spanish Fork Press.  The comment period will conclude at 6:00 p.m. on Monday, July 27, 2008.  For the public's convenience, a copy of the CAMU Application PDF document and the draft CAO PDF document may be viewed on line in pdf format.  In addition, during normal business hours 7:00 am - 6:00 pm, or other hours with prior arrangement throughout the comment period, hard copies of the CMS Report including all attachments and figures will be available for public review at the following locations:

Proposing changes to the Used Oil Management Rules (R315-15)


The Utah Division of Solid and Hazardous Waste is proposing changes to the Used Oil Management Rules (R315-15). The used oil management rules address the permitting of used oil facilities and the proper management and recycling of used oil in the state.  Specifically, R315-15-6.2 specifies that off-specification used oil may only be burned for energy recovery in certain devices, such as hazardous waste incinerators.  In addition, R315-15-13.6(b) requires facilities that desire to burn off-specification used oil to apply for and receive a permit from the Executive Secretary of the Utah Solid and Hazardous Waste Control Board prior to burning off-specification used oil.

The purpose of the proposed rule changes is to allow hazardous waste incinerator facilities which currently hold a hazardous waste permit issued by the Executive Secretary to burn off-specification used oil without the need to also obtain a separate off-specification used oil burner permit under the Utah used oil management rules, R315-15-13.6(b).

Currently, there is one permitted hazardous waste incinerator operating in Utah, and the requirements for storage, testing, and record keeping of materials (including off-specification used oil) to be burned at the facility are as stringent as the used oil management rules and permitting requirements.  Also, Division personnel inspect this hazardous waste incinerator facility on a regular and frequent basis to ensure compliance with the requirements of the hazardous waste permit.  Therefore, the proposed rule changes would eliminate the need for a separate off-specification used oil burner permit (if certain conditions are met), and would reduce the redundant requirements already addressed by the hazardous waste permit.

As part of the official rulemaking process, a required 30-day public comment period will commence on Wednesday, July 1, 2009 and end Thursday, July 30, 2009. ATK Launch Systems (ATK) and the United States Navy (the Permittees) for the operations at the Naval Industrial Reserve Ordnance Plant (NIROP) facility

The Executive Secretary of the Utah Solid and Hazardous Waste Control Board (the Board) is proposing to issue a Hazardous Waste Storage and Subpart X Thermal Treatment Permit (the Permit) to ATK Launch Systems (ATK) and the United States Navy (the Permittees) for the operations at the Naval Industrial Reserve Ordnance Plant (NIROP) facility in West Valley City, Utah.  NIROP is part of the Bacchus Facility and has been in operation since 1915.  NIROP is owned by the United States Navy and operated under contract by ATK which owns and/or operates the rest of the Bacchus Facility.  NIROP has operated under interim status since 1980. 

The Permit will replace the interim status for the NIROP hazardous waste management units and authorize the Permittees to use two hazardous waste storage units and a Subpart X thermal treatment unit in accordance with R315 of the Utah Administrative Code.  The hazardous waste storage units regulated by this Permit are: Explosive Storage #2 (ES-2) and the Ash Storage Pad.  The Subpart X thermal treatment unit is the NIROP Burning Grounds, treats explosive and reactive hazardous waste by open burning.

A copy of the draft Permit is available for review by the public during normal business hours at the Magna Library, 8339 West 3500 South, Magna, Utah.  A copy of the draft Permit and the complete administrative record for the NIROP facility is also available for review by the public at the Division of Solid and Hazardous Waste (the Division) office located in the Martha Hughes Cannon Health Building, 288 North 1460 West, Salt Lake City, Utah during normal business hours.  Normal business hours are Monday – Thursday between the hours of 7:00 am and 6:00 pm.

A 45-day public comment period will begin on July 2, 2009 when this notice is published in the Salt Lake Tribune, Deseret News and Magna Times and will expire at 6:00 pm on August 17, 2009.  The Division will hold a public hearing for this Permit on August 4, 2009 from 6:00 -7:00 pm at the Magna Public Library, 8339 West 3500 South, Magna, Utah.  Public comments will be collected during the public hearing.

Milestones

Emergency Permit UT-017-2009 was issued to Dugway Proving Ground to open detonate one M22, 66mm Rocket and any other similar munitions found in the OP1 Area in the vicinity of Wig Mountain.  The permit was effective 5/27/09 and will expire 11/27/09.  Contact: Doug Taylor
